After a Georgia DUI arrest, there may be two separate proceedings: the criminal case in court and an administrative license-suspension matter. Extra time in one does not automatically protect the other.
If an officer serves a DS-1205 notice, Georgia DDS materials describe a 30-calendar-day period to choose an available response, which may include requesting an administrative hearing or, for an eligible driver, pursuing an ignition-interlock permit. Missing that deadline can waive the hearing and allow the suspension process to move forward.
Bring every document from the arrest to counsel immediately. A defense plan should address driving privileges where possible while separately analyzing the stop, arrest, testing evidence, and criminal charge.
